jennlouise.com.au is a site operated by Exquisite Bags ("We"); we are a partnership registered in Australia, ABN 18 116 355 342. Our postal address is 6 Lena Street, Tuart Hill, WA 6060.
The following is an agreement confirming the Terms and Conditions for the sales made between customers making a purchase from the Jenn Louise websites jennlouise.com.au and jennlouise.com, and Jenn Louise (partnership). Once you have read the Terms and Conditions that follow, it is considered to be a binding agreement, as is using the websites listed above.
Terms of Website Use
Accessing our Site
Accesses to our sites are permitted on a temporary basis, and we reserve the right to withdraw or amend the service we provide on our sites without notice. While we aim for the sites to be available at all times, we will not be liable if for any reason our site is unavailable at any time or for any period.
Intellectual Property Rights
We are the owner of all intellectual property rights on our sites and all of the material published on it. All material, information, images and graphics are protected by copyright laws and treaties in Australia and around the world. All such rights are reserved.
You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way from our websites, and you must not use any illustrations, text, photographs, video or audio sequences or any graphics from our websites without prior permission from the owner.
Our identity as owner and author, and that of any contributors to the website, must always be acknowledged if material from the websites is ever used (with permission from Jenn Louise). You must not use any part of the materials on our site for personal or commercial purposes without obtaining written permission from Jenn Louise. Any such use of materials will be deemed an infringement of our rights.
We aim to update our site regularly, and may change the content at any time. If the need arises, we may suspend access to our site, or close it indefinitely. Any of the material on our site may be out of date at any given time, and we are under no obligation to update such material.
We aim to provide as accurately as possible all information provided on jennlouise.com.au and jennlouise.com however the material displayed on our sites is provided without any guarantees, conditions or warranties as to its accuracy. To the extent permitted by law, we, and third parties connected to us hereby expressly exclude:
- Loss of income or revenue;
- Loss of business;
- Loss of profits or contracts;
- Loss of anticipated savings;
- Loss of data;
- Loss of goodwill;
- Wasted management or office time; and for any other loss or damage of any kind, however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable, provided that this condition shall not prevent claims for loss of or damage to your tangible property or any other claims for direct financial loss that are not excluded by any of the categories set out above.
This does not affect our liability for death or personal injury arising from our negligence, or our liability for fraudulent misrepresentation or misrepresentation as to a fundamental matter, or any other liability which cannot be excluded or limited under applicable law.
Information about you and your visits to our site
Jenn Louise does not currently knowingly distribute or make available personal data obtained from customers to third parties at this time; however we reserve the right to do so in the future. If compelled to make data available to third parties, we will update policies listed on this site accordingly.
Viruses, hacking and other offences
You must not misuse our site by knowingly introducing viruses, Trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site.
By breaching this provision, you would commit a criminal offence under the Cybercrime Act 2001. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately.
We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our site or to your downloading of any material posted on it, or on any website linked to it.

Jurisdiction and applicable law
All product prices are given in Australian dollars inclusive of GST, but do not include delivery fees and charges. Jenn Louise reserves the right to alter its prices at any time without prior notice for any reason. The products will be invoiced according to the prices in effect at the time the order is completed. The products ordered will remain the property of Jenn Louise until full receipt of the payment is received. Payments must be made in full in one instalment at the time of purchase.
The customer may order from the jennlouise.com.au and jennlouise.com websites, if there are any queries relating to products or orders they can be directed to email@example.com and we will endeavour to reply within one working day. Please note that Jenn Louise is based in Perth, Australia so emails will be checked only during 9:00 to 17:00 Australian Western Standard Time.
All orders will be acknowledged within 24 hours of placement, however this does not confirm the order will proceed. The order contract only becomes binding only when payment has been accepted by Jenn Louise.
Jenn Louise reserves the right to cancel or refuse any orders from customers who have disputed previous orders and prices or anyone who Jenn Louise deems to be a risk to the partnership.
All orders imply acceptance of the prices, product descriptions and terms and conditions available at the time of sale. Jenn Louise aims to honour all orders received on the website to the best of their ability subject to product availability. If any of the products ordered are not available for whatever reason, Jenn Louise will contact the customer as soon as possible to advise them of their order status. In the event that the product is permanently unavailable then the purchase will be cancelled and the customer will be duly refunded in the same manner that payment was made.
Dispatch and delivery
Orders placed on the jennlouise.com.au and jennlouise.com websites before 12pm (Australian Western Standard Time) Monday to Friday (except Australian and Western Australian holidays) will be processed and dispatched the same day, subject to payment confirmation where at all possible. Orders received after 12pm will be dispatched the next business day.
Delivery is through Australia Post so all deliveries will be at the discretion of Australia Post delivery time frames. Orders will usually take around five working days within Australia, however this cannot be guaranteed at any rate and Australia Post holidays must also be taken into consideration. It is the responsibility of the customer to arrange pickup of the order should they be unavailable to receive the parcel when it is delivered.
Customers may pay for their purchases by:

The payment is confirmed on receipt of the additional information requested in case of payment by debit/credit card requiring additional checks.
Jenn Louise reserves the right to check the personal information given by the customer and to adopt any measures deemed necessary to check that the person whose bank account is being debited is the person who placed the order, to prevent fraudulent and incorrect payments. This check may take the form of a request for proof of identity and/or address and/or bank documents. If the customer fails to respond to a request such as this within two working days of the request made by Jenn Louise, the order in question will be automatically cancelled, with no option to make a subsequent complaint.
Jenn Louise is entitled to cancel any order that they perceive to present risk of financial fraud
Exchanges, returns and refunds
The customer has a legal cooling-off period of seven working days starting the day after delivery to cancel the contract. Jenn Louise extends this period to allow 90 days from the date of the order to the date the item is received back at the offices of Jenn Louise to return items, provided that the conditions stated in the paragraph below are met.
Any products returned must be new, unused and unaltered (including no scratches on the soles of shoes) and in the intact original box or cloth bag. Any exchange or return must be done via an exchange or return request in the "My Account" section on jennlouise.com.au and jennlouise.com
The exchange order will be dispatched where possible within 48 hours of the returned items being received at the office of Jenn Louise. In the event that the product requested for exchange is no longer available, the customer will be offered another product in exchange of their choice or offered a full refund. It is strongly recommended that the customer retain proof of postage in the case of returns, if the item is lost in transit and no proof of postage can be shown then no refund or exchange will be possible. If the amount of the customer's exchange order is lower than the initial order, Jenn Louise will refund the difference within 30 days of receipt of his returned package to our office.
Refunds will be completed in the same fashion as payment was made to Jenn Louise (Credit Card or Paypal).
All returned products (including all packaging) must be received at the office of Jenn Louise in exactly the same, intact condition as they were sent to the customer. On receipt of the returned package, it will be at the discretion of Jenn Louise as to whether the goods are deemed as being in the same condition as they were sent to the customer. No returns will be accepted if the returned products have been visibly used or damaged by the customer and if this use or damage has rendered the products unsuitable for sale.
If the returned product is refused by Jenn Louise, the product will then be returned to the customer at the expense of Jenn Louise. The customer may not demand any compensation and will not be entitled to any refund, unless they subsequently exercise their warranty rights for sold goods.
Jenn Louise will refund acceptably returned products within 30 days from the date of receipt of returned goods to the Jenn Louise office.
When subscribing to the Jenn Louise email updates and newsletter, you must provide accurate and up to date information.
Jenn Louise aims to respond to all emailed customer service queries, complaints or suggestions to firstname.lastname@example.org within one working day. Please note that Jenn Louise is based in Western Australia so Australian Western Standard Time should be considered. We aim to respond to and resolve complaints as quickly as possible.
